Yes. Just because something isn't available new any more doesn't mean you can pirate it. You can still look for trades, keys etc. Especially considering it's not a physical item.

I get what you guys are saying but this game in particular was never available on steam, and pretty much the only way to play it is to pirate it, or try and find a hardcopy on amazon ebay which usually go for insane prices.

I don't know anywhere where that wouldn't be considered piracy. Even games from decades ago (abandonware) is technically not legal to copy unless the original rights holder has released it. In some cases that isn't even possible since the company doesn't exist anymore and the rights are held by some paper entity.

I just read up on it and apparently EA can't sell it because they lost their rights to it, and these rights are now held by Middle-Earth Enterprises. Not sure if they actually have the rights to the game or just the LOTR brand, though.

For example, Lord of the Rings: Battle for middle earth isn't available to buy anywhere to the best of my knowledge. Would it still be considered pirating to download it without paying for it?
